Recently, a Florida appeals court reversed a jury's verdict against an accident victim because the defendant's lawyer, hired by the defendant's insurance company to defend the case, misled the jury. Many people don't know that in Florida a state statute prohibits the lawyers and judges from telling the jury that defendants have insurance to cover the claim, and if so, the amount of insurance money available to settle the claim. Insurance companies lobbied for this statute many years ago. They hope that jurors will be hoodwinked into feeling sorry for defendants who have been sued and fooled intobelieving every defendant had no insurance. Of course, defendants are rarely uninsured since attorneys cannot afford to take cases against uninsured defendants on a contingency fee basis when they can't expect to collect on successful lawsuits.

In the recent Florida case, the defendant's attorney actually told the jury that he was a "consumer justice attorney". He even said he didn't represent "some fancy company or conglomerate". In fact, he was being paid by an insurance company. This lawyer purposefully tried to leave the jury with the impression that the defendant was uninsured and paying for his own defense, a consumer who was seeking justice. This was not the case at all. Indeed, this insurance paid lawyer was a wolf in sheep's clothing.

The fact is that almost all personal injury or wrongful death cases are brought against insured defendants. Companies or people who have paid for insurance to cover exactly the kind of claim that is being brought before the jury.

Florida Wrongful Death Lawyers Advise Consumers To Return Deadly Products - Sunday, September 21, 2008


The Consumer Product Safety Commission has recalled yet another deadly dangerous product made in China. This time, it's a baby crib. The Simplicity brand Drop Side baby crib has been recalled due to serious entrapment and suffocation hazards to infants and toddlers.

Because of sizing problems with the crib's hardware, the drop side can come off its track, creating a hazardous gap that can entrap and suffocate a sleeping infant or toddler. The recalled model numbers include: 8620, 8745, 8748, 8755, 8756, 8778, 8810, and 8994. The recalled cribs have a date code found on the label of the headboard under the mattress support, which ends in 05DH, 05GB, 06GB, 07DH or 07GB. The recalled model names includ Apen and Crib 'N Changer Combo, Gabrielle, Camille, Providence and Shenandoah.

Dangerous scuba diving equipment has also been recently recalled. The Apeks Second Stage Scuba Regulators were recalled due to a drowning hazard. The regulators can be missing their diaphragm cover, resulting in a drowning hazard if the diaphragm is displaced during a dive.

The Origins of Traffic Deaths - Saturday, September 13, 2008

Road accidents have often been the cause of tragic accidents, injuries and deaths, including horse and carriage deaths dating back to the 10th century, causing the deaths of the King of France and two kings of England. Accidents and deaths since the introduction of motorized modes of transport, however, have increased exponentially.

The first death from a car accident is said to have been Mary Ward, an Irish scientist, in 1869. It is said she was struck by a steam powered automobile which witnesses said was travelling at a "reckless pace, like a fire engine." The driver claimed he was only going about 4 miles per hour. A coroner's inquest returned a verdict of an "accidental death" and there was no prosecution, witht he coroner saying he hoped such a thing would never happen again." A few years later in 1896, Bridget Driscoll was killed in a car accident in London, dashing the coroner's hopes.

Henry Hale Bliss was the first person to be killed in a motor vehicle accident in America. He was struck by an electric powered taxi cab when disembarking a street car in Central Park in 1899. His head and chest were crushed in the accident. He died from those injuries the next morning. The cab driver was charged with manslaughter but was acquitted on the grounds that the death was unintentional.

And with those events began the 20th century and the thousands among thousand of traffic deaths that have plagued society for almost 110 years. Such accidents are most often simply mistakes, not subject to criminal prosecution. The only justice is found in civil courts for monetary compensation to the families of the victims under wrongful death statutes which vary from state to state.

Florida Wrongful Death Lawyers Warn Of Recalled Tire Valve - Saturday, September 06, 2008

The Florida wrongful death attorneys at CGWC are warning their clients and friends of a recently recalled tire valve that can cause high speed blow-outs and serious personal injuries or death. A Florida man's death, as well as a recall of the faulty tire stems which were made in China, suggest that it would be wise to check your tire valve stems to see if they are from the lot of defective products.

These defective valve stems can crack prematurely, or under pressure, causing serious automobile accidents according to Safety Research and Strategies, a safety consulting company in Mississippi. Tech International, a U.S. distributor of the Chinese made tire valve stems, issued a recall of 6 million of them after a rollover death in Orlando. The National Highway and Traffic Safety Administration has also investigated these defective products. Dill Air Control Products sold and distributed the valve stems which were manufactured for Dill in China.

The valve stems include the TR-413, TR-413 chrome, TR-414 and TR-418 models, which were manufactured between August 2006 and November 2006. The stem is a rubber tube with a metal valve for inflating the tire. Cracks in the tire valve stems can lead to quick air loss which, at highway speeds, can result in blow-outs and serious automobile accidents.

It will be difficult, however, for consumers to determine if there car or truck has any of the defective tire valve stems Once installed, the identifying product information can only be found by dismountng the tire from the wheel and inspecting it from within. But the product liability attorneys at CGWC say it's worth it, if you bought new tires or a new car or truck since 2006.
