Pedestrian Decapitated By Tractor Trailer - Thursday, February 26, 2009

In Orlando today, a pedestrian was decapitated when run over by a semi-tractor trailer. Orlando is one of the most dangerous cities in America for pedestrians. In 2003, for example, Orlando ranked in the top 10 most dangerous cities for pedestrians. Cities with streets built for speed instead of safety are the most dangerous. We can certainly say that our streets allow high speeds in areas of high pedestrian traffic.

Epidemic of Nursing Home Neglect and Abuse - Thursday, February 12, 2009

According to a report by the U.S. Department of Health and Human Services, 94% of nursing homes in America have received citations for violations of federal standards of care. Despite this, Consumer Reports says state regulators only fine about 50% of the time they're found to provide this substandard care. As a result of poor care, unsupervised residents fall and sustain life-threatening and sometimes fatal injuries. Patients develop bedsores caused by patients being left in one position too long. Sometimes these sores, caused by unrelieved pressure from mattresses or wheelchair seats cutting off blood supply to bony prominences like heels, tailbones, and hips, penetrate all the way to the bone and become infected and fatal. Patients suffer from malnutrition, weight loss, dehydration and kidney failure.

Why are these results so common in nursing homes? Are senior citizens doomed to starve, suffer broken bones in falls, and become riddled with bedsores at the end of their lives in nursing homes? Are these tragedies just unavoidable consequences of getting old? Of course not. Understaffed nursing homes driven by the motivation to make enormous profits from Medicare and Medicaid dollars, your taxes, make such neglect and abuse all too common. If wealthy operators were satisfied with a little less profit, they could hire enough staff to minimize this neglect, and our parents and grandparents wouldn't be neglected in a whopping 94% of these nursing homes.

Workers Compensation Section of the Florida Bar meets in Miami - Monday, February 09, 2009

The Executive Council of the Workers Compensation Section of the Florida Bar met on Friday, January 16th 2009 in Miami to various issues that affect the Florida workers compensation system. The Executive Council is part of the Workers Compensation Section of the Florida Bar comprised of experienced attorneys from across the state of Florida, one-half of whom represent the rights of Florida's injured workers, and, one-half of whom represent workers compensation insurance companies. Items discussed included issues regarding the recent Florida Supreme Court case of Murray v. Mariner Healthcare, and its affect on workers compensation attorneys fees; the need for increased pay for the Judges of Compensation Claims; and various ways to improve the Florida Workers Compensation system in general. In attendance representing the rights of injured workers in Central Florida, was attorney Stewart L. Colling from the law firm of Colling, Gilbert, Wright & Carter in Orlando. The attorneys at Colling, Gilbert, Wright & Carter have represented injured workers in workers compensation matters, as well as claims involving all types of personal injuries, automobile accidents, nursing home abuse, and medical malpractice claims all over the state of Florida since 1986.

Head On Collisions Most Deadly - Sunday, February 08, 2009

Some of the deadliest automobile accidents are head on collisions. According to the Fatal Analysis Reporting System (FARS) 18% of fatal auto accidents were head on collisions in 1999. 75% of those occurred on rural undivided two lane roads. Statistics also indicate that most head on collisions are the result of "unintentional" maneuvers like falling asleep, distractions, speeding, or over-correcting on curves.

Rate Increase for Florida Workers Compensation Claims - Wednesday, February 04, 2009

The organization that collects data for Florida workers compensation claims, NCCI, has asked Florida Insurance Commisioner Kevin McCarty to increase workers compensation premiums charged to Florida employers an average of 6.4% in 2009. This request for a workers compensation insurance premium hike follows the recent Florida Supreme Court decision in the case of Emma Murray v. Mariner Healthcare, wherein the Court ruled that Florida attorneys representing injured workers who are successful in obtaining workers compensation benefits that the insurance company has wrongfully refused to provide, are to be paid a "reasonable fee" by the workers compensation insurance carrier. Florida Workers Advocates, a group of Florida attorneys who represent the rights of injured workers and the Florida Justice Association have each hailed the Murray decision as a necessary ruling that will enable injured workers to hire competent workers compensation attorneys to fight against insurance companies that wrongfully deny them benefits.
