Storm Damage? - Sunday, July 26, 2009

Summer season is the mean season for storms, including thunderstorms, windstorms, tornadoes, and hurricanes. You may think that your homeowners insurance will just send you a check for the damage. Homeowners insurance companies don't see it that way. If you have damage from a storm, your best bet is to get legal advice early, before you present your claim yourself. And if your claim is denied, you will assuredly need an experienced insurance dispute attorney to get what you paid for when you bought your insurance.

For a free consultation, call CGWC and speak to one of our attorneys who is experienced in homeowners insurance claims.

Summer Traffic Deadly - Saturday, July 25, 2009

An Apopka, Florida woman and an Apopka teenager who was a passenger in her car are among the four dead from a head on collision on Interstate 95 just south of Savannah, Georgia. A Clemson man was travelling the wrong way on Interstate 95 apparently causing the fatal auto accident.

Given the proximity of the two states and the heavy travel between them, motorists from both Georgia and Florida are often involved in accidents in both states. At The Florida Firm, two of our attorneys are licensed in both Florida and Georgia and can handle cases over state lines. Nathan Carter and Melvin B. Wright are both licensed to practice law in all state courts in both Georgia and Florida.

A Eustis woman was killed in a separate local auto accident on State Road 46.

Summer vacation travel can be particularly dangerous, so be careful and drive defensively.

Distracted Drivers Are As Dangerous As Drunk Drivers - Sunday, July 19, 2009

Extensive research by the National Highway Traffice Safety Administration shows that the use of cell phones while driving is extremely dangerous and needlessly endangers others. Drivers who are using cell phones are four times more likely to cause an accident as undistracted drivers, and the risk of a cell phone user causing an auto accident is the same as that of a driver under the influence alcohol at a .08 percent blood alcohol level.

A study at Harvard University estimates that drivers distracted by cell phones cause 2,600 auto accident deaths annually and 330,00 serious injuries each year. Despite all this, no states have banned cell phone use while driving, although some require hands free devices, which studies show doesn't improve the risks very much.

Distractions of any kind needlessly endanger others. So when you're driving, remember that it's not the time or place for multi-tasking. A moment of carelessness can lead to a lifetime of misery from injuries.

Uninsured Motorist Insurance - Thursday, July 16, 2009

With the unemployment rate at almost 10% and everyone cutting family budgets, some motorists are dropping liability insurance on their family automobiles to save money and cut household expenses. Not surprisingly, if you are involved in an automobile accident, the chances are greater than ever that you will be injured by an uninsured driver. How do you protect yourself? You make sure your auto insurance policy has uninsured and underinsured motorist coverage. This coverage takes the place of the liability insurance coverage that most people wrongly assume other drivers carry. Some estimate that as many as 1 of every 4 cars on the highway have no liability insurance. Far more automobiles have too little liability insurance to do you any good if you're seriousy injured or, worse, if a loved one is killed. Automobile insurance companies don't have to sell you uninsured motorist coverage, and many agents either discourage it or don't explain it adequately when you apply for coverage. The fact is that you NEED uninsured and underinsured motorist coverage to protect you from folks who drive with little or no liability insurance.

If you've been injured by an uninsured or underinsured motorist, don't assume your policy doesn't cover you. Insurance companies have to follow strict rules in excluding uninsured and underinsured motorist coverage from any auto insurance policy. If they don't, you're covered. Call CGWC for a free consultation about your legal rights.

Florida Today Says Lawsuits Don't Cause Costly Health Care - Wednesday, July 08, 2009

An article in Florida Today recently said that lawsuits should not be blamed for the high cost of health care. Republicans and the American Medical Association are pushing for limits on lawsuits to be a part of any health care reform. After analyzing five years of data, Florida Today concluded that medical malpractice lawsuits did not cause physicians to practice defensive medicine as claimed.

First, Florida Today concluded that soaring health care costs have negated any pay increases for average Americans since the 1990's. Meanwhile, Florida enacted caps on damages as well as attorneys' fees in medical negligence cases, while also making cases more expensive for attorneys to prosecute. In addition, the number of medical malpractice lawsuits have decreased by 8% since 2005 and the statistics are that Florida's malpractice insurers are the most profitable in the nation. Finally, the average doctor's malpractice premiums have decreased by 8% in the past three years.

Florida Today noted that malpractice victims already have to get other doctors to swear that there is a case of malpractice and then wait three months for the malpractice insurance company to decide whether to fight the case or settle, and that there are other restrictions on cases that stack the system against patients. So, Florida Today asks, why make it even harder for patients to sue? It's not bringing down the cost of health care.

Florida Medical Malpractice Attorneys Often See Wrongful Deaths In Hospitals - Thursday, July 02, 2009

According to a recent study by Healthgrades, an average of 195,000 deaths in hospitals annually in 2000, 2001 and 2002 in the United States were caused by potentially preventable medical errors. Thirty seven million patient records were reviewed. This study was published in the Journal of the American Medical Association in October 2003. This study supported an earlier study in 1999 by the Institute of Medicine which found that medical errors caused 98,000 deaths each year and should be considered a national epidemic.

If a loved one has died during a hospital admission, the cause of the wrongful death could have been medical malpractice. Florida's medical malpractice laws are complex and navigating the legal system in a medical negligence case calls for an experienced medical malpractice attorney. Call CGWC for a free consultation and learn about your legal rights.
