Patient at Orlando-area assisted-living facility died of neglect, - state halts admissions - Sunday, November 15, 2009

A Patient at an Orlando-area assisted-living facility died of neglect, while others suffered. The state halts admissions to the facility.

Inspectors from the Agency for Health Care Administration found a total collapse in delivery of care when asked to inspect the assisted living facility following the death of the resident. Inspectors found that a resident died from a failure to administer prescribed heart medication, and that another resident had to be hospitalized when given blood thinning medication that had not been prescribed. Employees were also found to have falsified medication administration records and nurses' orders.

At The Florida Firm, we regret to say that such neglect in nursing homes and assisted living facilities is all too common, and we have represented hundreds of families who fell victim to abuse or neglect in nursing homes and assisted living facilities. Medical Malpractice Reform Hurts Patients - Wednesday, November 04, 2009

Forbes magazine recently published an article by a California State University economics professor finding that damage caps in medical malpractice lawsuits hurts patients. The article is based in part upon a Congressional Budget Office report estimating that tort reform measures, including damage caps, would eliminate the oversight of the free marketplace, i.e. penalties of practicing bad medicine imposed by jury verdicts. Capping verdicts was suspected to reduce the efforts of the private market, i.e. hospitals, doctors offices, etc. to investigate incidents and reduce risks of substandard care. The fact is that the civil court system is the private market's method of encouraging the practice of good medicine and discouraging the practice of bad medicine. Patients harmed by the substandard care should not have their remedies limited, and health care providers who practice bad medicine should be held accountable to pay for their mistakes.

Britain Enacts Tough Laws Banning Texting While Driving - Monday, November 02, 2009

Britain has enacted tough new laws banning cell phone use while driving. Texting while driving is given especially harsh punishment in the U.K. Composing text messages at the moment of a collision is not even necessary to evoke harsh criminal punishment in the event of an accident. Reading or composing text messages "over a period of time" is considered a "gross unavoidable distraction" exposing the wrongdoer to the same type of punishment available for those driving while drunk or high on drugs.

Clermont Child Killed In Halloween Accident - Sunday, November 01, 2009

The Center For Disease Control reports that 4 times as many children between 5 and 14 are killed on Halloween compared to any other time of the year. Unfortunately for a Lake County family, a young boy was killed when attempting to cross State Road 50 while being supervised by and adult on Halloween evening. This family did everything right, it seems, since the child was reportedly crossing the busy road at an intersection with adult supervision. It is critical for drivers to pay special attention when children are out trick or treating or going to other Halloween events.
