Florida Wrongful Death Lawyers Advise Consumers To Return Deadly Products - Sunday, September 21, 2008

The Consumer Product Safety Commission has recalled yet another deadly dangerous product made in China. This time, it's a baby crib. The Simplicity brand Drop Side baby crib has been recalled due to serious entrapment and suffocation hazards to infants and toddlers.

Because of sizing problems with the crib's hardware, the drop side can come off its track, creating a hazardous gap that can entrap and suffocate a sleeping infant or toddler. The recalled model numbers include: 8620, 8745, 8748, 8755, 8756, 8778, 8810, and 8994. The recalled cribs have a date code found on the label of the headboard under the mattress support, which ends in 05DH, 05GB, 06GB, 07DH or 07GB. The recalled model names includ Apen and Crib 'N Changer Combo, Gabrielle, Camille, Providence and Shenandoah.

Dangerous scuba diving equipment has also been recently recalled. The Apeks Second Stage Scuba Regulators were recalled due to a drowning hazard. The regulators can be missing their diaphragm cover, resulting in a drowning hazard if the diaphragm is displaced during a dive.

If you or a loved one has been injured by a dangerous product, call CGWC for a free consultation about whether you are entitled to compensation from the manufacturer of the dangerous product under product liability laws.

Florida Wrongful Death Lawyers Warn Of Recalled Tire Valve - Saturday, September 06, 2008

The Florida wrongful death attorneys at CGWC are warning their clients and friends of a recently recalled tire valve that can cause high speed blow-outs and serious personal injuries or death. A Florida man's death, as well as a recall of the faulty tire stems which were made in China, suggest that it would be wise to check your tire valve stems to see if they are from the lot of defective products.

These defective valve stems can crack prematurely, or under pressure, causing serious automobile accidents according to Safety Research and Strategies, a safety consulting company in Mississippi. Tech International, a U.S. distributor of the Chinese made tire valve stems, issued a recall of 6 million of them after a rollover death in Orlando. The National Highway and Traffic Safety Administration has also investigated these defective products. Dill Air Control Products sold and distributed the valve stems which were manufactured for Dill in China.

The valve stems include the TR-413, TR-413 chrome, TR-414 and TR-418 models, which were manufactured between August 2006 and November 2006. The stem is a rubber tube with a metal valve for inflating the tire. Cracks in the tire valve stems can lead to quick air loss which, at highway speeds, can result in blow-outs and serious automobile accidents.

It will be difficult, however, for consumers to determine if there car or truck has any of the defective tire valve stems Once installed, the identifying product information can only be found by dismountng the tire from the wheel and inspecting it from within. But the product liability attorneys at CGWC say it's worth it, if you bought new tires or a new car or truck since 2006.

If you or a loved one have been involved in an automobile accident or another type of accident, call CGWC for a free consultation.

Nation's Top Doctors Agree Personal Injury Lawsuits Promote Safety - Tuesday, August 19, 2008

At least when it comes to pharmaceutical companies, doctors agree that personal injury and wrongful death lawsuits promote safety. The editors of the New England Journal of Medicine, one of the most influential medical journals in the United States, recently submitted an amicus brief to the Supreme Court of the United States in a product liability lawsuit against the manufacturer of phenergan, a medication used to combat nausea, particularly during hospitalizations.

The injured victim lost her arm below the elbow by amputation due to gangrene after being injected with phenergan. She sued the manufacturer and alleged the company failed to warn of such dire consequences. The manufacturer appealed a 7 million dollar verdict arguing that the Food and Drug Administration's approval of the medication's labelling eliminates any liability under federal law. The label didn't specifically warn of such tragic consequences as gangrene and amputation. The NEJM editors urged the Supreme Court to be skeptical of allowing drug manufacturers to escape liability based on FDA approval of labelling, arguing that the FDA is overwhelmed in trying to keep up with drug safety issues, lacks the ability to be the sole guarnator of drug safety, and that lawsuits help guarantee drug safety.

The Florida personal injury attorneys at CGWC have long known that what we do in courtrooms is the best way to ensure that others act carefully and safely, whether they are drug manufacturers, drivers of motor vehicles, property owners, employers, hospitals, or doctors. It comes as no surprise that the fine physicians at NEJM would recognize this. Government agencies have their place in regulating businesses and professions to help ensure safety, but bureaucracies are never capable of ensuring safety alone. The civil justice system always has and always should have its role in ensuring safety and compensating those injured by the negligence of others. If you have been hurt by someone or something, you may have legal rights. Call CGWC for a free consultation.

Orlando Wrongful Death Lawyers Question Traffic Fatality Statistics - Friday, July 25, 2008

According to some, rising gas prices has had the recent positive effect of reducing traffic deaths nationwide. The National Safety Council reports a 9% reduction in traffic fatalities so far in 2008 as compared to 2007. The Associated Press claims some states have reported drops of 20% in motor vehicle deaths and that 31 states have reported at least a 10% decline in traffic accident deaths. Preliminary figures show the death rate in Florida has dropped 11%. But at CGWC, we think it seems hard to believe those statistics. This week alone, there have been four deaths from motor vehicle accidents in Orange County alone in the past 48 hours. So, don't let your guard down. Remain vigilant and attentive, and drive defensively. High gas prices may be keeping people off the roads to some degree, but Central Florida's streets and highways remain the biggest risk to your daily safety.

Florida Personal Injury Attorneys Rely On Experts To Prove Your Case - Saturday, July 19, 2008

Whether your case involves an automobile accident, an injury on someone else's property, a construction site injury, an on the job injury, medical malpractice, nursing home neglect, or a dangerous product, it may surprise the public that Florida personal injury attorneys must often rely upon experts to prove your case and get you the compensation you deserve.

Most judges are conservative and existing case law often binds them to take your case away from a jury and throw it out of court unless you have met the burden of proof they believe the law requires. Especially in close cases, experts can carry the day, and the personal injury lawyers at CGWC know this. Whether your case calls for an expert in medicine, nursing, engineering, product design, accident reconstruction, job safety, construction safety, or some other field of endeavor, CGWC knows where to find the appropriate expert and has the resources to hire them with no money up front from you. If you or a loved one has been injured, or if a loved one has been the victim of a wrongful death, call CGWC for a free consultation.

Cars and Bicycles Make for Deadly Mix - Thursday, May 08, 2008

Bicyclists are at risk for very serious and life threatening injuries or death whenever struck by a automobile or other motor vehicle due to the relative lack of protection a bicyclist has available in a crash. Bicyclists account for about 2% of road deaths and injuries. According to the National Highway and Traffic Safety Administration and the Insurance Institute for Highway Safety, about 700 to 750 bicyclists died in traffic accidents from 2000 to 2004.

Here are ten ways bicyclists can avoid being struck by automobiles:
  1. Get and use a headlight and rear light on your bike.
  2. Get and use a loud horn on your bike.
  3. Get and use a mirror.
  4. Slow Down.
  5. Avoid drivers' blind spots.
  6. Don't ride on the sidewalk.
  7. Don't pass on the right.
  8. Look behind you before turning either right or left.
  9. Wear something bright...even during the day.
  10. Don't ride against traffic.
Of course, wear a helmet at all times. Despite their best efforts, the safest bicyclist is no match for a reckless or careless motorist. If you or loved one has been injured in a bicycle-automobile accident or, worse, if a loved one has died in a bicycle accident, call CGWC for a free consultation.

You do have legal rights in cases of injury or wrongful death, and an attorney should be retained promptly so that a proper investigation can be performed and your rights protected.
