Fosamax Manufacturer on Losing End of Bellwether Trial

The pharmaceutical company Merck recently lost a bellwether trial concerning side effects caused by the drug Fosamax. The plaintiff in this case developed a bone disease called osteonecrosis of the jaw (ONJ), and sued Merck for marketing a defective product and failing to adequately warn of the drug’s potential risks. Fosamax has also been connected to femur fractures. Fosamax has been named in thousands of lawsuits alleging that it caused osteonecrosis of the jaw, and hundreds more from individuals who suffered low-impact femur fractures while taking the drug. Merck has successfully defended themselves in five bellwether trials, and this was the second of these ONJ cases where the plaintiff prevailed. In this case, the jury did not find that Merck had marketed a defective product, but did find that the company had failed to warn of the risks associated with Fosamax.
